Each year the Berkeley Rent Board passes an Annual General Adjustment (AGA) which allows landlords to raise the rents for all rental units fully covered by the Berkeley Rent Ordinance for which the landlord did not establish an initial rent during the prior calendar year.  The yearly increase is set by taking 65% of the Consumer Price Index for All Urban Consumers in the Bay Area during the period from July 1st through June 30th of the prior year. This formula was approved by the Berkeley voters in the November 2004 general municipal election.

Landlords, remember that you cannot raise the rent for the remainder of the year in which the tenancy started, and for one additional calendar year.  For example:

Regardless of when a tenancy started, a landlord is not eligible to take the AGA if the property is not properly registered with the Rent Board, or if there is an order from the Rent Board denying AGAs (generally due to a decrease in services or substandard conditions).  If you are unsure whether you can raise your tenant's rent by the AGA, call a Housing Counselor at 510-981-RENT (981-7368).
