PG&E is reporting a widespread outage affecting thousands of customers in Berkeley and many City buildings, including the Finance Customer Service Center and the Permit Service Center. Call respective City services for further details, or check the PG&E outage page. Power is expected to return by 12:45pm. Traffic lights that are not working should be treated as a four-way stop sign.

Judicial Council of California Emergency Rule 1: Unlawful Detainers (issued 4/6/2020)


On April 6, 2020, the Judicial Council of California approved Emergency Rule 1 related to Unlawful Detainers. This rule disallows the majority of eviction lawsuits (unlawful detainer complaints) from being heard in superior court for a period of time.

For any eviction notices that are served on or after April 6, 2020, these proceedings are on hold until 90 days after the expiration of the California State of Emergency. The court clerk will not issue any summons for these cases until the conclusion of such time period.

For unlawful detainer complaints filed and summons issued before April 6, 2020, courts cannot enter default judgments unless:

1. It is necessary to protect public health and safety; AND

2. The tenant failed to appear in court

In cases where the complaint was filed and summons was issued before April 6, 2020, and the tenant responded timely in court, the trial must be at least 60 days after the landlord makes request for trials UNLESS the court finds it is necessary to protect public health and safety.

Any trial set before April 6, 2020 must be continued at least 60 days from the initial trial date.

This Rule will remain in effect until 90 Days AFTER Governor lifts the State of Emergency or until it is amended or repealed by the Judicial Council.
