A Notice of Apparent Lawful Rent Ceiling is an informational, non-binding document, which reflects the Rent Board’s information on the rent ceiling for a unit.  It also lists the number of bedrooms, the number of occupants, and the housing services included in the rent ceiling, if that information is available.  The Board generally mails Notices of Apparent Lawful Rent Ceiling twice a year to landlords and once a year to tenants.

Landlords' Notices list all the units on a property and are mailed out before tenant notices so that landlords have an opportunity to contact the Board and the tenants if they disagree with the Board’s records. The most common reason a Notice might contain out-of-date information is that the landlord has not yet filed required information concerning a new tenancy.  Landlords who wish to submit information to change the Rent Board’s database must do so in writing.

Tenants who find that their current rent is above the amount shown on the Notice should call a Rent Board counselor at 981-7368.  If they have written information to show that the Notice is in error (like a lease which reflects a different rent) they should submit it to the Rent Board by mail or in person at 2125 Milvia Street, Berkeley, CA 94704.
