Landlords filed an appeal of a hearing decision denying exemption of the lower unit, an unpermitted dwelling that lacks a Certificate of Occupancy. On appeal, Landlords argue that the Rent Board is required to follow a 2009 determination of exemption despite an intervening change in the eligibility of such unpermitted units for exemption. Landlords also argue that applying rent control to their property would be an unconstitutional taking, that the voters misunderstood the effect of Measure AA, that Measure AA and Regulation 510 are preempted by the Costa-Hawkins Rental Housing Act, and that the decision applies the law retroactively. These arguments misconstrue both the law and the legal effect of board action. The hearing examiner correctly determined that the subject unit is not exempt under Costa- Hawkins, nor under Measure AA, nor under Regulation 510. Therefore, the decision should be affirmed.
