This is a landlord appeal of a hearing examiner decision that awarded the tenant a rent ceiling reduction for the lack of a heater. The decision further informed the parties that the tenant would be able to file a petition in the future for loss of use of the cabana/porch area immediately adjacent to the front door of tenant’s apartment if and when that structure is demolished as the landlord has proposed it will be. The landlord argues that the tenant is not entitled to a rent reduction for the lack of a heater because she did not allow the landlord access to the apartment and that she should not be allowed a future rent reduction for the cabana/porch area because she did not prove that the yard was a part of her rental agreement. A review of the record establishes that the hearing examiner correctly ruled on the issues before the Rent Board. Therefore, the decision should be affirmed.
