6. Appeal Time Certain – 7:15 p.m. Appeal T-5188 (1675 Euclid Ave., Unit 1)

Landlord appeals a hearing examiner decision ordering him to refund a total of $884.20 to tenant for rent overcharges related to code violations and decreases in services.  On appeal, the landlord argues that the hearing examiner should not have awarded as much of a rent reduction because the evidence did not support the award for damages.  Landlord also argues that he was not afforded sufficient opportunity to cross-examine the tenant regarding photographs that were submitted after the hearing.  A review of the record establishes that the hearing examiner correctly ruled on the issues before the Rent Board.  Therefore, the decision should be affirmed.
