PG&E is reporting a widespread outage affecting thousands of customers in Berkeley and many City buildings, including the Finance Customer Service Center and the Permit Service Center. 6. Appeals - Time Certain - 8:00 PM

a. Appeal T-3899 - 1704 Francisco Street, Apartment A. The landlord and tenants appeal the hearing examiner's decision that found that the rent for the subject unit had not been set by making a good-faith estimate of the median rent for comparable units when the unit was rented in 1987. The landlord contends that the challenge of the legality of the 1987 rent was barred by the Petris Act (Civil Code section 1947.8), laches, waiver, and the Board's own regulations. In the alternative, the landlord claims the rent set was a good faith estimate of the median rent for comparable units. The tenants challenge the landlord's eligibility for the 1981, 1982 and 1988-1995 AGA's granted by the Rent Board. The decision was issued in accord with the state law, the Rent Ordinance and Rent Board regulations. Neither the landlord nor the tenants have raised grounds that warrant modifying the decision. Accordingly, it is recommended that the decision of the hearing examiner be affirmed.
