Appeal in L-3631 – 2212 Ward Street, Unit B. (Petitioner continued first hearing from February 15, 2001 meeting). This is an appeal of a hearing examiner decision that held that a rent increase cannot be granted on an agreement of the tenant to pay a higher rent at some future date after the establishment of the initial rent at the commencement of the tenancy. The landlord claims that the denial of the rent increase interferes with his constitutional right to contract. However, it is well settled law that rent regulation does not violate the constitutional prohibitions against the impairment of contracts. For this reason, it is recommended that the decision be affirmed.
