6. Appeals - Time Certain - 7:30 PM

Appeal T-3765-3771/T-3785-3786 - 2223 and 2227 Bonar Street. Both the tenants and the landlord appealed the decision of the hearing examiner. The tenants cite several clerical errors and ambiguities in the decision that need to be corrected or clarified, as well as claiming that the landlord should have been found ineligible for annual general adjustments (AGA's) beginning in 1989. The landlord claims that the rent reductions awarded after November 1999 are not supported by the evidence. There are, however, several ambiguities that need clarification from the hearing examiner. Therefore, it is also recommended that the petitions be remanded to the hearing examiner with instructions to clarify when the rent reductions for deteriorated floors were intended to end and to set forth in detail what needs to be done to "refurbish" each rental unit.
