 Appeal in T-3802/3803/3804 – 2455 Prospect Street, #231, #237 and #303. This is an appeal of the hearing examiner decision denying a request for a continuance even though a witness was unavailable to testify. The unavailability of a witness is grounds for a continuance under Regulation 1224. Therefore, provided that appellant makes an offer of proof concerning the relevancy of the testimony the witness is prepared to give, it is recommended that the matter be remanded for an additional hearing.
