Rent Stabilization Board

At its regular meeting on October 15, 2007, the Berkeley Rent Stabilization Board adopted the Annual General Adjustment (AGA) Order for Year 2008, which will allow eligible landlords to increase the 2007 permanent rent ceilings by 2.2%.

The 2008 AGA of 2.2% represents 65% of the increase in the Consumer Price Index for All Urban Consumers in the Bay Area during the 2006 fiscal year, which was 3.358 % as posted by the Bureau of Labor Statistics in July 2007. The 65% of CPI formula was approved by the voters at November 2004 general municipal election.

The 2008 AGA may not be charged to tenants whose tenancy began on or after January 1, 2007, and who had their rents set pursuant to the Costa-Hawkins Rental Housing Act. The Order also sets forth the conditions for qualifying for this rent increase and the notice that must be given to tenants in order to raise the rent. The full text of the regulation and order may be viewed in the Rent Board office at 2125 Milvia Street or at Rent Board website. If you have any questions, you may contact Jay Kelekian at 644-6128.
