2003 Annual General Adjustment Determined

At its October 21, 2002 meeting, the Berkeley Rent Stabilization Board passed an Annual General Adjustment (AGA) order for Year 2003 that keeps rents for rent-controlled apartments unchanged for the next 12 months.  The Rent Board's decision to adopt a zero ($0) AGA was based on an annual operating cost study which showed that, overall, the cost of operating and maintaining most rental units in Berkeley remained the same from June 2001 to June 2002 and actually decreased for master-metered properties.  The study, which was prepared by Seifel Consulting Inc., a San Francisco economic consulting firm, tracked the changes for 27 different expense categories and reported a substantial decrease in the cost of natural gas while most other expenses remained flat.  In concluding that no general adjustment was warranted for 2003, the Rent Board followed the same methodology it has used for determining the past seven years' AGAs, all of which resulted in across-the-board rent increases.  A copy of Seifel Consulting Inc.'s study is available for downloading by clicking on the link below (you must have Adobe Acrobat Reader installed) or may be viewed at the Rent Board's offices

The Annual General Adjustment Order for 2003 (Regulation 1125) adopted by the Board reads as follows: 

Pursuant to the provisions of Section 11 of the Rent Stabilization and Eviction for Good Cause Ordinance, as amended, the Rent Stabilization Board has considered setting and adjusting the rent ceiling for all rental units covered by the Ordinance. 

The Board has determined that the lawful rent ceilings established in the Annual General Adjustment Order for 2002 shall remain in effect for 2003.  There shall be no increase or decrease in the rent ceiling for any covered unit in 2003 except pursuant to Civil Code Section 1954.53 or pursuant to the Individual Rent Adjustment process set forth in Section 12 of the Ordinance and the applicable regulations.
