Appeal E-69  (3007 and 3009 Shattuck Avenue)

Landlord appeals a hearing examiner decision holding that the units at the property did not qualify for an exemption under Berkeley Municipal Code Section 13.76.050F.  The decision clarified that the landlord did not own enough of the building to qualify for the exemption under the plain language of the law. On appeal, the landlord claims that the property has always been his “political estate,” that he owned enough of the property to qualify for the exemption, and that the City did not pursue a lawsuit for fees and penalties in the 1980s and therefore admits that it is not entitled to collect those fees and penalties today. A review of the record establishes that the hearing examiner correctly ruled on the issues in the record. Therefore, the decision should be affirmed.
