Changes to development standards for new construction in commercial districts
and changes to implementation of state density bonus law

Due to concern regarding the potential impact proposed Proposition 98 (on the June 3 statewide ballot) could have on the city’s ability to regulate land use, the Berkeley Planning Commission and City Council recently considered the proposed changes to development standards as they were proposed in the fall of 2006. A public hearing was held on April 8.  The Council adopted the staff recommendation on April 22, 2008.

Proposition 98 failed on the statewide ballot, and these changes were automatically repealed.  The Planning Commission will continue consideration of the proposed changes in the summer and fall of 2008.  Please check back to this website for updates. The Planning Commission will continue to consider the proposed changes separately from this April 8 hearing in order to make recommendations to the City Council on the Joint Density Bonus Subcommittee’s recommendations for changes to development standards and changes to implementation of state density bonus law. The Planning Commission considered the recommendations of the Joint Subcommittee on Density Bonus at the following meetings: 


In the fall of 2005 the City Council established a Joint Subcommittee on Density bonus, consisting of members of the Planning Commission, Housing Advisory Commission, and Zoning Adjustments Board. The charge of the Subcommittee was to make recommendations to the Council on possible changes to the City’s existing density bonus procedures.  In the fall of 2006, recommendations for changes to development standards developed by the Subcommittee and Planning Department staff were brought to the City Council for consideration. In spring 2007, the Subcommittee made final recommendations on implementation of density bonus law.

September 2006 Reports on the Joint Subcommittee on Density Bonus Recommendations  
On September 19, 2006 the City Council adopted Planning Department recommendations that would have reduced development envelopes for new construction in certain commercial districts. The amendments included a sunset clause that automatically repealed the amendments after failure of Proposition 90 on November 7, 2006. The amendments are not in effect.
