Encroachment Permits


All permanent structures built in public right-of-way. Minor encroachments include those encroachments less that 2 feet in the public right-of-way which are not connected to a building. Major encroachments include all other encroachments.

Enabling Resolution/Ordinance: 

Chapter 16.18 BMC - Resolution No. 57165 - N.S. dated October 28, 1993.

Payment Provisions: 

Time of Payment:     Partial upon submittal and remainder upon approval

Location Of Payment:      Permit Service Center, 2120 Milvia Street

Payment Conditions:     Check, cash or credit card.

Inspections After Fee is Paid: 

Council approval is required for those major encroachments which extend more than 2 feet into public right of way or which are structurally attached to a building. Minor encroachments can be approved by the Director of Public Works or his designee.

Other Pertinent Information: 

Only issued for very limited circumstances.
