Appeal IRD-33  (2412 Atherton Street, Unit 4)

Landlord appeals a hearing examiner decision prohibiting the landlord from setting a market rent for a vacant room in the rental unit.  On appeal, the landlord argues that the hearing examiner misapplied a California Appeals Court case to the facts of the instant case; that the landlord detrimentally relied on a previous Rent Board decision and letter from a Rent Board Staff Attorney when setting his rent in the manner that he has for many years; and that the Rent Board should allow the landlord to register four separate units with each of the four bedrooms within the rental unit considered a separate unit.  A review of the record establishes that the hearing examiner correctly ruled that the landlord was not currently entitled to a vacancy rent adjustment for a vacant room in this rental unit.  For this reason, legal staff recommends that the Board affirm the hearing examiner’s decision.

(5) Update on pending legislation and recommendation to endorse SB 426 declaring dog-fighting and cockfighting as a nuisance subjecting the tenant to eviction, and AB 818 requiring availability of recycling in multi-family dwellings of five or more units, and instruct our Legislative Advocate to assist in the passage of these bills (Executive Director)
