Cannabis Commission

To ensure that cannabis provision in Berkeley is conducted in a safe and orderly manner to protect the welfare of Qualified Patients and the community. The commission shall consist of nine members.  At least one commissioner shall be a member of a medical cannabis dispensary, one shall be a member of a collective that is not a dispensary, and one shall be a cultivator who is not primarily associated with a single dispensary and provides medical cannabis to more than one dispensary.

Communications received by noon Monday the week before the meeting (10 days prior to meeting) will be included in the packet of materials mailed to the Commission before the meeting. Communications received after this deadline will be distributed at the meeting. These late items will be added to the end of the agenda packet, and marked as "Late Items".

Enabling Legislation:
The Berkeley Medical Cannabis Commission was established under the authority of Berkeley Municipal Code Section 12.26.110, as amended by its authorizing legislation, the Patients Access to Medical Cannabis Act of 2008 (aka Measure JJ), passed on November 4, 2008.  On November 2, 2010, Berkeley voters passed Measure T - Amendments to Medical Cannabis Regulations, making further changes to the structure and responsibilities of the Medical Cannabis Commission.  On May 16, 2017, Berkeley Municipal Code 12.26.110 was amended to change the name and mission of the Medical Cannabis Commission to include recreational cannabis.

Dispensary and Collective Regulations:    
The City Council approved new regulations for medical cannabis dispensaries and collectives on July 8, 2014.  These regulations became effective on August 9, 2014 and allow the City Council to select a 4th dispensary:

                Chapter 12.27 (new)

Manufacturing Regulations:
Manufacturing businesses that involve medical cannabis are subject to the same regulations as other light manufacturing businesses, except that the product can only be sold on a wholesale basis (not directly to patients), and will pay taxes associated with a medical cannabis business. For more information, see Zoning Ordinance Section 23E.16.070.C.

Proposed Cultivation Regulations:
The City Council considered a draft ordinance recommended by the MCC at the January 31, 2017, Council meeting. The Council voted to make changes recommended by staff and to limit the number of cultivation sites to six. The ordinance will not take effect until the Zoning Ordinance reflects the cultivation limit. See the annotated agenda for more details on the action taken by the City Council.
