Both the landlord and the tenant appeal the hearing examiner's decision on the landlord's petition for capital improvement rent adjustments. The landlord spent approximately $769,000 renovating the six-unit stucco building that had been built in the 1920's. The hearing examiner found that $469,000 of the work qualified for rent adjustments under Board Regulation 1267. The remaining $300,000 of work was found not to qualify. On appeal, the landlord contends that the renovation should be considered as a single capital improvement project and a rent adjustment should be granted based on the entire cost. Conversely, the tenant claims the work was required because the building had been neglected for 25 years and no adjustments would be granted. Upon review, staff recommends that the adjustment granted for replacing the concrete stairs in front of the building should be denied. Otherwise, the decision of the hearing examiner should be affirmed.
