Appeal T-4682; 2202 7th Street. The tenant filed a petition for an award of security deposit interest and a rent refund based on alleged habitability violations in her unit. The hearing examiner awarded security deposit interest and ordered a rent refund. On appeal, the tenant claims she was denied due process and the decision of the hearing examiner is not supported by the evidence. A review of the record establishes that the tenant received a fair hearing and that there is substantial evidence in the record to support the findings and decision of the hearing examiner. Therefore, other than correcting a clerical error in the calculation of the amount of the tenant's security deposit, staff recommends that the decision of the hearing examiner be affirmed.
