Recommendation: Adopt a Resolution affirming the decision of the Zoning Adjustments Board (ZAB) to deny Use Permit No. 13-10000023 to construct a new, two-story, approximately 3,000 square-foot duplex and a 432 square-foot single story dwelling within a relocated accessory structure at the rear of the City of Berkeley Landmark site known as the "Bartlett Houses."

2. ZAB Appeal: 2204 Dwight Way (Continued from January 13, 2015)

Recommendation: Adopt a Resolution affirming the decision of the Zoning Adjustments Board (ZAB) to deny Use Permit No. 13-10000024 to construct a new, three-story, approximately 3,224 square-foot duplex at the rear of an existing 5,400 square-foot site.

Action: Items 1 and 2 taken up concurrently.

Action: 21 speakers.  M/S/C (Bates/Maio) to remand Item 1, ZAB Appeal: 2201-2205 Blake Street, and Item 2, ZAB Appeal: 2204 Dwight Way, to the Zoning Adjustments Board with the direction to consider the following:

  • Review of the new plans submitted by the appellant
  • Parking requirements for the project
  • Home ownership of the units
  • CC&Rs addressing behavior of occupants
  • Review the usability of the open space and solar access
  • Review the plans for the driveway

Vote: Ayes – Maio, Moore, Capitelli, Wengraf, Droste, Bates; Noes – Anderson, Arreguin, Worthington.
