New laws went into effect October 1, 2017

Berkeley, California (Wednesday, October 11, 2017) - The City of Berkeley Minimum Wage increased by more than a dollar on October 1, when most people working in Berkeley also obtained the right to accrue and use sick leave benefits with fewer restrictions than under state law.

For most employees of businesses and nonprofits, the minimum wage increased from $12.53 to $13.75 per hour.   For young people enrolled in a government or non-profit run job training program, the Minimum Wage increased from $10.50 to $12 per hour.

Berkeley's Paid Sick Leave ordinance requires that all employees earn one hour of paid sick leave for every 30 hours worked. Small businesses - those with fewer than 25 employees - may cap an employee's accrual and use of paid sick leave to 48 hours per year. Larger businesses -those with more than 25 employees companywide -- may cap employee's accrual at 72 hours per year but may not cap the use of earned Paid Sick Leave.

In contrast, the California Paid Sick Leave law allows all employers to cap accrual and use of Paid Sick Leave at 24 hours within a calendar year.

Under the ordinances approved by the City Council, the Minimum Wage and Paid Sick Leave laws only apply to employees who work at least two hours per week within Berkeley city limits.

Employers must post a Public Notice issued by the City at all worksites that informs employees of their rights under these ordinances. Employers that do not have a physical worksite must provide a copy of the Public Notice directly to employees.
