2015 ANNUAL GENERAL ADJUSTMENT - At its regular meeting on October 20, 2014, the Berkeley Rent Stabilization Board adopted the Annual General Adjustment (AGA) Order for Year 2015 which will allow eligible landlords to increase the 2014 permanent rent ceilings by 2.0%. The 2015 AGA of 2.0% represents 65% of the increase in the Consumer Price Index (CPI) for All Urban Consumers in the Bay Area during the period from July 1, 2013 - June 30, 2014, which was 3.0% as posted by the Bureau of Labor Statistics. The 65% of CPI formula was approved by the voters in the November 2004 general municipal election. [more...]
SECURITY DEPOSIT INTEREST INFORMATION and CALCULATOR - Attention Tenants and Property Owners: Property owners must use the "Berkeley Bank Rate" when calculating the amount of security deposit interest to return to tenants. Property owners are no longer required to provide evidence that deposit funds are kept in Berkeley banks. The interest rate to be paid in December 2014 for security deposits held from November 1, 2013 through October 31, 2014 is 0.1%.
The interest rate for all April 2015 move-outs is 0.1%. The interest rate for a December 2014 annual return of Security Deposit Interest: 0.1%. [more...]
TENANT ELIGIBILITY FOR $4.00 REGISTRATION FEE PASS-THROUGH REIMBURSEMENT 2014-2015 - The Rent Stabilization Board approved Resolution 14-03 which authorized landlords to pass through a portion of this year’s fee for tenancies that commenced prior to January 1, 1999. [more...]
RENT STABILIZATION BOARD PUBLIC NOTICE - On November 17, 2014, the Berkeley Rent Stabilization Board, by way of a second reading, adopted Regulation 509 – Definition of New Construction for Legal Rental Units.
This regulation makes clear that the Board will only consider a legal unit to qualify as new construction if it has received a Certificate of Occupancy issued after February 1, 1995. This standard is consistent with Costa Hawkins. Regulation 509 also makes clear that all units that were previously exempt before the passage of Costa Hawkins shall remain exempt. All units constructed as the result of rehabilitation, conversion, or partial demolition of existing units where a Certificate of Occupancy has not been issued shall not qualify as new construction.

FY 2014-2015 REGISTRATION INFORMATION - ANNUAL REGISTRATION FEES OF $194 PER UNIT WERE DUE TUESDAY, JULY 1, 2014.The Rent Stabilization Ordinance requires that payments not received in the Rent Board Office or postmarked by the due date be assessed a 100% penalty. Rental units must be properly registered in order to take rent increases and/or evict tenants. Most property owners may be eligible for a waiver of part or all of the penalty fees if their account is fully paid on or before September 1st, 2014 . SMOKING PROHIBITION ADDENDUM - The Berkeley Rent Board is committed to promoting safe and healthy housing for all. To ensure that rental units remain smoke free, landlords should always include a smoking prohibition clause in a lease agreement for a new tenancy. So that no resident is subject to the harmful effects of second hand smoke, we are also encouraging all sitting tenants and landlords to voluntarily agree to sign an addendum to their existing lease agreement that prohibits smoking on the premises if the original agreement does not already contain this prohibition.
