Preliminary Matters

Roll Call: 6:33 p.m. Mayor Bates absent. Vice-Mayor Olds presiding.

Public Comment – Limited to items on this agenda only – 0

Closed Session – Conference Room

The City Council recessed to closed session at 6:35 p.m. to discuss the following matter:

1. CONFERENCE WITH LABOR NEGOTIATOR PURSUANT TO GOVERNMENT CODE SECTION 54957.6: Unions: Berkeley Police Association (PDF, 13 KB)

City Negotiators: Philip Kamlarz, City Manager; Lisa Caronna, Deputy City Manager; Tracy Vesely, Budget Manager; Doug Hambleton, Police Chief; David Hodgkins, Director of Human Resources; Margarita Zamora, Senior Human Resources Analyst

The City Council reconvened to special session in the Council Chambers at 7:00 p.m. noting that there was no reportable action taken as a result of the Closed Session.

2. Elmwood Theater Business Improvement Area (PDF, 39 KB)

Recommendation: Conduct a public hearing and upon conclusion adopt a Resolution:

1) Confirming the Annual Assessment Report for the Elmwood Theater Business Improvement Area for FY 2007; and

2) Levying assessments in the Area for FY 2008.

Councilmember Capitelli returned to the Council Dais.

3. Adoption of Findings-Town Dollars and More Discs ("B-Town") - 2973 Sacramento Street (PDF, 85 KB)

From: City Attorney

Recommendation: Adopt a Resolution including findings and order that B-Town, a retail store located at 2973 Sacramento, is a public nuisance and must cease operations forthwith, as previously determined by the City Council on July 17, 2007, after a public hearing.
