Comments from the City Manager:  The City Manager may make announcements or provide information to the City Council in the form of an oral report.  The Council will not take action on

such items but may request the City Manager place a report on a future agenda for discussion.

Comments from the Public:  A total of thirty (30) minutes is scheduled.  Each speaker is limited to a maximum of three (3) minutes.

Council Action: The City Council may take action related to any subject listed on the Agenda.

The Council will consider removal and addition of items to the Consent Calendar prior to voting on the Consent Calendar. All items remaining on the Consent Calendar will be approved in one

motion.  Items removed from the Consent Calendar will be held over to the next meeting unless the City Manager requests action due to priority.

1. Needle Exchange Emergency Distribution

   Recommendation: Adopt a Resolution reviewing and confirming the continued existence of a local emergency with regard to HIV transmission from use of HIV-infected needles among injection drug users, and authorizing the Local Health Officer to take steps to enable the operation of needle exchange emergency distribution.

3. Prohibition on Establishment of Office Uses in the Dwight - Hillside Area (first reading vote October 16, 2001 - unanimous)

   Recommendation:  Adopt second reading of an Ordinance amending Berkeley Municipal Code (BMC) Section 23D.40.050 to permanently prohibit the establishment of office use in that portion of the Multi-Family Residential-Hillside (R-4H) District identified as the Dwight-Hillside area and repealing Section 23e.96.100.

4. Definition of an Unreinforced Masonry Wall (first reading vote October 16, 2001 - unanimous)

   Recommendation:  Adopt second reading of an Ordinance amending Berkeley Municipal Code (BMC) Section 19.38.010 to add new Subsection (b) to correct a technical error in the definition of an unreinforced masonry wall.

5. Restrict Code Violations as Grounds for Eviction (CF112-01)

   Recommendation:  Adopt first reading of an Ordinance amending Berkeley Municipal Code (BMC) section 1.26.010, to provide that the declaration that all ordinances violations constitute public nuisances in not intended to define the term “nuisance” for purposes of Code of Civil Procedure section 1161(4) for purposes of restricting code violations as grounds for eviction.

6. Closed Sessions for Board/Commission Subcommittees

   Recommendation:  Adopt a Resolution establishing certain rights for boards, commissions and committees to further provide that it shall not apply to subcommittees seeking legal advice from the City Attorney or meeting with the City Manager or his designees to address real estate, labor or personnel issues, and rescinding Resolution No. 60,504-N.S.

7. Settlement Agreement:  Beatty/Budget Rent A Car

   Recommendation:  Adopt a Resolution approving the property damage settlement of Public Liability Claim No. GHB 010284 submitted by Reverend William Paul Beatty and Budget Rent A Car in the amount of $17,173.54.

8. Contract:  Emergency Housing

   Recommendation:  Adopt a Resolution authorizing the City Manager to execute a contract in an amount not to exceed $100,000 with the Flamingo Motel to provide emergency housing for individuals who are homeless and seriously mentally disabled for the period July 1, 2001 through June 30, 2002.

9. Lease:  1013 Pardee #105
   From:  City Manager
   Recommendation:  Adopt first reading of an Ordinance authorizing the City Manager to execute a lease agreement with Asia Young Fountain Group, Inc., for a three-year lease, from September 1, 2001 through August 31, 2004, at the rate of $9,219 per month, or $331,884 for the term of the lease, for space at 1013 Pardee #105, to be used for the storage of trucks, emergency supplies and equipment.

10. Lease:  2809 Telegraph Avenue
    From:  City Manager
    Recommendation:  Adopt an Ordinance authorizing the City Manager to execute a five-year lease and maintenance agreement with Phil O‘Hay for real property located at 2809 Telegraph Avenue in an amount not to exceed $400,000 for the period December 15, 2001 through December 14, 2006, to provide additional office space for the Department of Health and Human Services, Mental Health Division.

11. Salary Increase for Auditor I/II and Accountant I/II Classifications

    Recommendation:  Adopt a Resolution amending Resolution No. 59,883-N.S., Classification and Salary Resolution for SEIU Local 535 Employees,  to approve equity salary increases for Auditor I / II and Accountant I / II classifications, effective November 1, 2001.

12. Supplemental Military Leave Benefit

    Recommendation:  Adopt a Resolution providing six months of supplemental military leave benefit to employees who have been called to active duty as a part of the United States response to the September 11, 2001 attacks.

13. Contract:  Telecommunications Consultant Services
    From:  City Manager
    Recommendation:  Adopt a Resolution authorizing the City Manager to amend the agreement with Smith, Fause, and McDonald, Inc. for telecommunications consultancy services by increasing the amount $25,000 for a total contract amount not to exceed $172,200 and extending the period to December 31, 2002.

14. Contract:  Shorebird Environmental Learning Center – Straw Bale Building

    Recommendation:  Adopt a Resolution: 1) rejecting all bids; and 2) authorizing the City Manager to negotiate on the open market and execute a contract with a qualified building contractor in an amount not to exceed $396,000 to complete construction of the Straw Bale Building.

15. Agreement:  Berkeley Bay Trail Project
    From:  City Manager
    Recommendation:  Adopt a Resolution authorizing the City Manager to execute an amendment to the Cooperative Funding Agreement with the State of California Department of Transportation (Caltrans) to accept an additional $800,000 of State TEA funds, for a total State contribution of $3,500,000 for the construction of the Berkeley Bay Trail.

16. Contract:  Sanitary Sewer Project

    Recommendation:  Adopt a Resolution: 1) approving plans and specifications for the Sanitary Sewer Project at Maryland Avenue, Colorado Avenue, Michigan Avenue, Kentucky Avenue, Vermont Avenue, Boynton Avenue, Avenida Drive, Olympus Avenue, Fairlawn Drive, Mosswood Road, Arden Road, and Orchard Lane;  2)  accepting the bid of McNamara and Smallman Construction, Inc.;  and 3) authorizing the City Manager to execute a contract and any amendments in an amount not to exceed $1,428,190, for a period of 150 calendar days.

17. Fee Waiver:  17^th Annual Telegraph Avenue Holiday Street Fair
    From:  Councilmember Worthington
    Recommendation:  Adopt a Resolution 1) waiving event, sound and insurance fees associated with the fair; 2) allowing an exemption to Berkeley Municipal Code (BMC) section 20.24.040, thereby allowing a banner to be hung across Telegraph Avenue and vertical banners on light poles advertising the event; 3) extending the sound permit from 11-6 PM.; 4) closing Telegraph Avenue from Dwight to Bancroft allowing only cross traffic through; 5) approving the City’s provision of the following in-kind services for the Holiday event: 4 portable toilets provided by Public Works, dumpster and Solid Waste services, traffic signage and traffic engineering services, and assistance from Public Works in the hanging of banners; and contributing $2,500 to the Holiday Fair for its continued success.

18. Telegraph Area Association Holiday Marketing Campaign

19. Charter Amendment:  Effective Date of Redistricting
    From:  Mayor Dean
    Recommendation:  Request the City Manager develop a charter amendment providing that redistricting occur at a date after adjustments to the census count, if any, have been received, with elections from the new districts to be held at the next general election following this revised redistricting process; the amendment to be placed on the March 2002 ballot and worded such that, if approved by the voters, the charter amendment becomes effective immediately, and all current redistricting plans are voided, and old council districts remain in effect while new redistricting process takes place.

20. Warning Siren for Jet Fuel Pipeline (to be delivered)
    From:  Mayor Dean
    Recommendation:  Request the City Manager evaluate as soon as possible the installation of a warning siren connected to the jet fuel pipeline in West Berkeley; work with Congresswoman Barbara Lee regarding potential funding sources; and report back to Council.

21. Reimbursement by University of California for Costs from Campus Incidents
    From:  Mayor Dean
    Recommendation:  1) Endorse the October 16 letter from Mayor Dean to UC Chancellor Berdahl requesting reimbursement for costs and damages incurred by the City as a consequence of campus social events sponsored by the University and held on campus but spilling over onto City streets; 2) include endorsement for the reimbursement of local businesses, property owners, and individuals for their costs and damages arising from the event; 3) establish this reimbursement as official City policy; and 4) refer this matter to the City Manager with a request that he explore the ramifications and details of the reimbursement policy and arrangements, and report back on progress made.

22. Traffic Safety at Sixth and Virginia

    Recommendation:  Request the Transportation Commission and the City Manager immediately examine the traffic situation at Sixth and Virginia and determine what interim or permanent measures might be implemented to enhance the safety of that intersection.  A report back to Council to be made as soon as possible.

23. School Traffic Safety Plans

    Recommendation:  Request the City Manager 1) review progress on filing school traffic safety plans; 2) determine what the City needs to do to increase the effectiveness of those plans, including:  the installation of warning signs that drivers are in School Zones and need to decrease speed and enforcement of speed laws around schools and major street crossings to school zones; 3) do this on a systematic basis, starting with elementary public and private schools in the South quadrant of the City and moving northward, then reviewing intermediate school plans, and finally high schools; and 4) make reports to the 2x2 Committee on an incremental basis, with a final report to be made to Council.

24. Berkeley Mutual Aid Agreements of Oakland Fire Station Rebuilding

    Recommendation:  Refer to the City Manager for evaluation the impact on Berkeley’s mutual aid agreements of the City of Oakland proposal to temporarily reduce both the number of firefighters on duty and equipment available while their 51^st Street Station in North Oakland (Station 8) is rebuilt; and, if there is a negative impact, express our concern and consider what assistance, if any, Berkeley might be able to offer or what measures Berkeley should take internally to lessen that impact.

25. Relocate Berkeley Free Folk Festival

    Recommendation:  Adopt a Resolution to provide funding in the amount of $5,000 to allow the Berkeley Free Folk Festival venue to take place at a larger and more accessible space with an accessible stage and for a sound system.

27. Parking Rates at Center Street Garage

    Recommendation:  Conduct a public hearing and upon conclusion adopt a Resolution changing the start time for evening parking at the Center Street Garage from 6:00 p.m. to 5:00 p.m.. and increasing the evening flat rate from $2 to $4.

28. Annual Business Assessment for the Downtown Berkeley Business Improvement District

    Recommendation:  Conduct a Public Hearing, and upon conclusion adopt two resolutions to:  1) Confirming the 2002 Annual Report of the Downtown Business Improvement District (BID), thereby levying an annual assessment for the Downtown BID for calendar year 2002; and 2) Authorizing the City Manager to execute a sole source contract and any amendments with the Downtown Berkeley Association (DBA) Main Street Program for $219,000 of Downtown BID funds to support Downtown revitalization.
