SESSION: (The Council will
recess into Closed Session immediately after CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Significant exposure to litigation pursuant to subdivision (b) of Government Code section 54956.9 Threat of and Exposure to Litigation The
City Attorney has issued an opinion concluding that four members of the
Landmarks Preservation Commission (LPC) should disqualify themselves from
the Beth El project and any other matter on which the Berkeley
Architectural Heritage Association (BAHA) has taken a position before the
LPC as to these projects, because three of the four commissioners were
members of the board of BAHA when it took these positions and the fourth
LPC member has been on the staff of BAHA during this period.
Antonio Rossman, an attorney, has been quoted in the November 10,
2000 issue of the Berkeley Daily Planet
as saying that he will sue the City on behalf of the four
commissioners unless the Council determines that such commissioners may
participate in the LPC decisions. The
Council will meet with its attorneys in closed session to discuss the
threat of such litigation. ADJOURNMENT: (The Council may adjourn this meeting to the City Council Chambers, 2134 Martin Luther King Jr. Way, and reconvene into Open Session at 7:00 p.m. to make a report, if any such report is required by law.) |
