WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Significant exposure to litigation pursuant to subdivision (b) of
Government Code section 54956.9 Metromedia
Fiber Network, Inc. (MFN) a telecommunication company has applied
for an encroachment permit to construct fiber optic lines under various
streets in Berkeley. There is a significant likelihood, in the City Attorney’s
opinion, that the City will be subject to suit if the City requires MFN to
obtain a franchise from the City rather than an encroachment permit.
The City Council will be meeting with its attorneys to discuss the
City’s exposure to this litigation. ADJOURNMENT:
(The Council may adjourn this
meeting to the City Council Chambers, 2134 Martin Luther King Jr. Way, and
reconvene into Open Session at 7:00 p.m. to make a report, if any such
report is required by law.) |
