SPECIAL BERKELEY CITY COUNCIL MEETING

TUESDAY, JUNE 22, 1999, 5:30 P.M.

AGENDA

ROLL CALL: 5:30 P.M.

PUBLIC COMMENT: (Ten minute maximum)

Under the Council Rules of Procedure each speaker will be entitled to speak for no longer than two minutes and the total time allocated for public comment shall be no longer than ten minutes. Public comment shall be confined to subjects on this agenda.

CLOSED SESSION: (The Council will recess into Closed Session immediately after Public Comment or immediately after Roll Call if there are no public speakers)

The City Council will recess to closed session to discuss each of the following matters, not necessarily in the order listed below:

CONFERENCE WITH LEGAL COUNSEL- PENDING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(b):

People v. Arcadia Machine & Tool, et al.

(San Francisco County Superior Court Case No. 303753)

CONFERENCE WITH LEGAL COUNSEL- THREATENED LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(b):

1. The Council will confer with its attorneys regarding possible litigation arising out of Council action relating to regulation of certain ATM fees as threatened in a letter dated April 27, 1999 from Rodney R. Peck.

2. The Council will confer with its attorneys regarding possible litigation arising out of the City’s consideration of a management study of the Black Repertory Theater Group as threatened in a letter dated May 25, 1999 from Wayne Johnson.
