Chapter 19.72 COMMERCIAL BUILDINGS--ENERGY CONSERVATION MEASURES
Section 19.72.100 Transfer of compliance responsibility between buildings owned by a single party.
When a party owns two or more commercial buildings in the
City of Berkeley and only one of
those buildings has become subject to this chapter by virtue of its sale or a major renovation
thereto, the owner may transfer his or her responsibility for compliance with this chapter from
the subject building to any other of his or her buildings in the City as long as:
A. The owner installs the energy conservation
measured required by this chapter in any of
his or her other buildings in a dollar amount equal to or exceeding the maximum required
expenditure which would have been expended upon the subject building, and
B. The owner executes and files with
the City an inter-building compliance responsibility
transfer request ("transfer request"), stating that:
1. The subject building is entitled
to one of the exemptions described in Section 19.72.080,
or
2. The building owner's intentions
for the subject building would render the implementation
of the energy conservation measures in the subject unreasonable because:
a. The building owner intends to demolish
the subject building within three years, or
b. The building owner intends to keep
the subject building vacant for three or more years.
