Chapter 19.72 COMMERCIAL BUILDINGS--ENERGY CONSERVATION MEASURES
Section 19.72.070 Credits and exclusions toward maximum required expenditures.
A. Expenditures to comply with the
Unreinforced Masonry Ordinance and the Americans
with Disabilities Act--ten percent. When a major renovation is undertaken to comply with the
provisions of the Unreinforced Masonry Ordinance (Berkeley Municipal Code, Chapter 19.64),
or the Americans with Disabilities Act (42 U.S.C. 12101 et seq.), the maximum expenditure
required to comply with this ordinance shall be reduced by ten percent of the cost of the
renovation undertaken to comply with such laws.
B. Expenditures for energy conservation
measures installed within the past three years--ten
percent. When any of the energy conservation measures required by this chapter have been
installed in the commercial building within the past three years, ten percent of the cost incurred
therefor may be applied to the maximum required expenditure under this chapter.
C. Fees associated with audits, inspections
and permits--excluded. The fees incurred for
audits, inspections, filing fees, or permits shall not be credited towards the maximum
expenditures required under this chapter. (Ord. 6176-NS § 7, 1993)
