7.    Appeal Time Certain – 8:00 p.m.

a. Appeal D-42  (1628 Walnut Street, Upper unit)  Tenant Respondents appeal a hearing examiner decision that found that the tenants’ primary residence is in St. Louis, Missouri, and therefore the tenants’ rental unit in Berkeley, is exempt from the rent ceiling restrictions of the Rent Ordinance.  On appeal, the tenants argue that they always intended to make Berkeley their home, and that the decision is not supported by the facts of the case.  A review of the record, however, establishes that the decision is supported by substantial evidence.  For this reason, legal staff recommends that the decision of the hearing examiner be affirmed.
