Parking Citations

You can pay a parking citation online or by phone at any hour, or come to the Customer Service Center during business hours (8:30 a.m. to 4:00 p.m. Monday through Thursday, closed on Fridays). If you want to contest a citation and request an administrative review or hearing, instructions and further information can be found here.

Paying a Citation

You can pay your parking citations at any hour using Online Service Center: Parking Ticket Information or the 24-hour IVR payment line at (866) 226-9288. You will need the citation number issued against your vehicle and your MasterCard or VISA.

You may also pay your parking citation at the Customer Service Center during business hours (8:30 a.m. to 4:00 p.m. Monday through Thursday, closed on Fridays).

The Process of Contest a Parking Citation

The City of Berkeley follows the process as established by the State of California to contest a parking citation (California Vehicle Code 40215)  Contesting a citation is a three level process consisting of:

  • Step One - An Administrative Review
  • Step Two - An Administrative Hearing
  • Step Three - Court Appeal to Superior Court

You may not skip either the Administrative Review or Administrative Hearing and file immediately for a Superior Court ruling.

 Step One - Administrative Review

  • You  must request an Administrative Review in writing within 21 calendar days of citation issuance or within 14 days from mailing of Notice of Violation.  Notice of violations are sent to the registered owner of the vehicle.
  • Request for Administrative Review may be made:
    • By mail - send a letter or download the Request for Administrative Review Form (also available at Customer Service) and mail with supporting evidence to City of Berkeley, Citation Processing Center, P.O.Box 54017, Los Angeles, CA 90054-0017
    • In person - deposit at theCustomer Service Center at 1947 Center St., 1st Floor, Berkeley, CA 94704 a letter of explanation (or Request for Administrative Review form, available at Customer Service) with supporting evidence.
    • Online -  Contest Citation Online
  • If you are requesting Administrative Review of a citation, there is no payment necessary until a final Notice of Decision has been made on your citation.  After your Review response is mailed, if the citation is found to be "Not Valid," it will be dismissed and you don't need to take any further action.  If your citation is not dismissed, within 21 days the penalty will be due in full OR you may request an Administrative Hearing.
  • Follow these steps when submitting an Administrative Review of your citation:
    • Enclose the original citation or a copy of your citation with your Review request
    • Enclose any evidence as that would assist in your Review, as supporting evidence is required for dismissal.Examples include:
      • Disabled Placard and/or ID card
      • Residential Parking Permit holder information
      • Photographs
      • Statements from witnesses
      • Receipts, timecards, medical records or any other documentation that might support dismissal of your citation.
      • Documentation including picture, receipts, etc will be retained for the record.
  • Based on your written explanation and supporting evidence provided, the City will determine whether there is sufficient proof to dismiss the violation and mail you  a written Administrative Review Decision.
  • If your citation is found to be "Valid," you have the option of paying the penalty at the original amount or having an Administrative Hearing, per Step 2.

Step Two - An Administrative Hearing

If you are dissatisfied with the Administrative Review result, you may, within 21 days of the mailing date of the Administrative Review Decision, have an Administrative Hearing before a Hearing Examiner in person or by mail.

Note:  Under California Vehicle Code section 40215(b), you must provide a deposit of the full amount of the parking penalty before having a hearing unless you fill out a Request to Waive Hearing Deposit, supported by your most recent Federal Tax filings or other acceptable documents as described on form.  You may request a Waiver of the Fee form here or by calling 1-866-226-9288.  Hearing deposits can be made by check or money order or in person with a check, money order, cash or Visa or MasterCard.

Request to Waive Hearing Deposit

  • The Request to Waive Hearing Deposit form must be completed and returned with the request for in-person hearing before the due date on your Notice of Administrative Review Decision.
  • Question 1 through 5 must be answered and the Request to Waive Hearing Deposit form signed under penalty of perjury on #7.
  • You must provide evidence to support the household gross monthly income ($37, 400 or less) with either a complete copy of income tax return, a Letter 4506-T from the Internal Revenue Services (IRS) stating you did not file taxes for the year, and/or Proof of Supplemental Security income, Social Security Assistance, Unemployment, Retirement, or Pension Fund payments.
  • Your application and supporting documents will be reviewed to determine if you are eligible for a waiver of penalty of hearing deposit and you will received a written response to your request by mail before you appear for your pre-scheduled In-person hearing or by mail in the case of a hearing by mail.
  • If your citation is not dismissed at the In-person hearing, or hearing by mail, payment will be due within 21 days from the date of the decision or the fine will increase.

In-Person Administrative Hearings

To schedule an In-Person hearing, please do the following:

  • Detach the payment coupon from the Administrative Review Liable letter and check the box:  Hearing in person requested
  • Mail detached coupon with the full amount of the citation as required for the hearing deposit OR an approved waiver of deposit.  (Check or Money Order)
  • Mail items to:
    • City of Berkeley
    • Citation Processing Center
    • P.O.Box 54017
    • Los Angeles, California 90054-0017
  • The City of Berkeley will process your request and mail you a notice with the date & time of your in-person hearing.
  • A customer does not get to choose the in-person hearing date.  The dates for the hearing are chosen on a first come basis and only available by mail.  (No phone request permitted)
  • The hearings are usually scheduled three weeks after the request is received and will be within 90 days of the requests for hearing.
  • All in-person hearings will be scheduled on Monday: 9:30 am to 12:30 pm and Wednesday: noon to 4 pm (in 15 minute intervals), excluding holidays.
  • The person requesting the hearing must cancel or change the hearing appointment 48 hours before the date and time of the hearing by calling 1-866-226-9288
  • A person may reschedule the hearing, one time, by calling 1-866-226-9288.
  • The hearing schedule will be posted on the hearing room window at 1947 Center St, 1 day prior to the date of the hearing.
  • If you have questions regarding your hearing please call 1-866-226-9288.

Follow these steps when submitting an Administrative Hearing:

  • It is crucial to the success of your request for dismissal that at the time of your Administrative Hearing you submit all supporting evidence such as:
    • Photographs
    • Witness Statements
    • Any and all other documents in support of your appeal

All documentation submitted will be retained in the hearing file.

You will be notified of the Hearing Officer's determination at the end of the hearing or soon afterward by mail.  (It is suggested that you retain the hearing decision as a receipt for your records.)  If the Hearing Officer determines your citation should be dismissed your deposit will be refunded.  If the Hearing Officer determines your citation will not be dismissed, the deposit paid with your hearing request will applied to your citation.  If you do not agree with the decision you may request an appeal to Superior Court (see Step Three).

Administrative Hearings By Mail

A Hearing Examiner will review your Written Declaration and supporting evidence, accompanied by your check or money order for the full amount of the deposit, and a Hearing Decision will be mailed to you.

  • Here also, it is crucial to the success of your request for dismissal that at the time you submit your Administrative Hearing by mail, you submit all evidence such as:
    • Photographs
    • Witness Statements
    • Any and all other documents in support of your appeal

All documentation submitted will be retained in the hearing file.

You will be notified by mail of the Hearing Officer's determination of your Hearing by Mail.  If the Hearing Officer determines your citation should be dismissed, your deposit will be refunded.   If the Hearing Officer determines your citation will not be dismissed, the deposit paid with your hearing request will be applied to your citation.  If you do not agree with the decision you may request an appeal to Superior Court (see Step Three).

Step Three - Appeal to Superior Court 

Note:  According to California Vehicle Code section 40230(a), you may NOT skip the Administrative Review or Administrative Hearing and file immediately for a Superior Court ruling.

If the Hearing Examiner does not dismiss your citation and you wish to continue contesting the citation, you may appeal the decision to Superior Court.  You must request an appeal within 30-calendar days of the date of the Hearing Examiner's decision.  You must file for the appeal in person at the Superior Court.  There is a $25.00 filing fee per citation required by the Court, which will be refunded to you if the judge rules in your favor.

 Superior Court hours are 8:00 a.m. to 4:00 p.m., Monday through Friday, except during Court Holidays and Furloughs.

Correctable Citations

Effective August 1, 2009, if citations for registration (CVC 4000A), and equipment (CVC 5204, 5200, & 5201) violations  are corrected within 30 days from the date of the notice of violation  with proof of correction  provided, the penalty amount will be reduced to $10 pursuant to CVC 40225 (C). The $10 correction fee must accompany the evidence of correction, sign-off for which may be obtained from any police officer, Berkeley Parking Officer or DMV official in the space designated on the back of the parking citation or notice of violation. After 30 days from the notice of violation proof of correction will no longer be accepted and the fine must be paid in full.


If your vehicle was timely registered with DMV at the time you received a CVC 5204 or 4000 (A) citation you may be eligible for complete dismissal of the penalty if you provide supporting evidence of your compliance through the Administrative Review process, described on the back of the citation.  


Check List for Correctible Violations

  1. Correction must be made within 30 days from Notice of Violation
  2. Proof of correction evidenced by signature of any Police Officer, DMV or Berkeley Parking Enforcement Officer
  3. Payment of $10.00

Citations for expired registration CVC 4000 must be signed by a Police Officer, Parking Enforcement Officer or DMV Employee.
